Assignment Of Copyright

The author or owner of the copyright in an existing work can assign to any person his particular rights in the copyright either partially or wholly or subject to conditions, either for the whole term of the copyright or any part as may be specified by him. It shall be in writing signed by the author or the owner. It should clearly indicate the specific works and specify the rights assigned and the duration and territorial upto which the rights extent. It shall also specify the amount of consideration payable to the author, if any . If the assignee does not exercise the rights assigned to him within a period of one year from the date of assignment, the assignment in respect of such rights shall be deemed to have lapsed after the expiry of the period unless otherwise particularly in the assignment. If the period of assignment is not mentioned in the agreement, it is deemed to be five years from the date of assignment.
